Review of Three Year TN Visa Rule Completed

On September 10, 2008, the Office of Information and Regulatory Affairs (OIRA) completed its review of DHS’ proposed rule to extend the period of TN visa status from one to three years.

The OIRA has labeled its completed review as “Consistent with Change,” which means OIRA has approved the regulation with changes from when it was received. According to OMB Watch , OIRA will label a completed review as “Consistent with Change” for minor changes, such as the insertion of a comma, as well as for substantive changes that may affect the very nature of the regulation.

Until the Final Rule is published there is no way of knowing what changes were made to the proposed rule. The rule is now in the Final Stage and should be ready for publication shortly.
